摘    要:SA8000公司社会责任标准的出现是公司社会责任理念的标志性体现。在贸易保护主义抬头的今天,该标准很可能成为抑制中国出口贸易发展的“合理借口”。中国应该以SA8000为导向,修正中国《公司法》以加强对中国公司职工利益的保护。立法应该扩大职工参与公司治理的范围,明确规定职工代表享有的权利,从而保证职工利益得到切实的保护。

Abstract:The appearance of the SA8000 corporation society responsibility standard is the sign unfolding of the idea of "company society responsibility". Today it is the ground which is in the trade protectionism; this standard may becomes the reasonable excuse which can suppress our export trade development. We should take SA8000 as the guide, revises our country "corporation law" in order to strengthen our company staff beneficial protection. The legislation should expand the participation scope of the company governing, explicitly stipulates the rights which the representative of the staff enjoy. We do so in order to guarantee the staff benefits to come true.
