Analysis on the Illegality of the Trade-based Production and Process Methods

In the GATT and WTO, when trade measures regulate the methods of production of a product to protect the environment, these restrictions are called as trade-based production and process methods (PPMs). PPMs have become the primary focus of the debate and negotiations in global organizations including the WTO. This paper analyzes the GATT's and WTO's provisions on the trade-based production and process methods (PPMs), including the analysis on GATT Article I, Article III, GATT Article XX, and the Agreement on Technical Barriers to Trade (TBT). Based on the analysis, the paper tries to illustrate that most of the PPMs is against the WTO provisions and threats seriously to the free trade system.
