传统文化产权的法经济学分析——基于文化资源稀缺性的视角

传统文化作为一种稀缺性资源,其产品具有公共物品属性。由于现行法律规范的缺位,传统文化产权界定不明晰。在传统文化资源开发利用的过程中,存在严重的＂搭便车＂行为,产生了巨大的外部效益问题,导致社会文化资源的低效甚至是无效配置。应加强对传统文化资源的法律保护,有效界定传统文化产权,实现其外部性内部化。

The Law and Economics Analysis on Traditional Cultural Property——Based on the Perspective of Scarcity on Culture Resource

Traditional culture is a kind of scarcity resources,and its products are of public goods attribute.Due to the absence of the current legal norms,the definition of property right of traditional culture is not clear.In the development and utilization process of the traditional culture resources,there is a serious ＂free-rider＂ behavior,resulting in a huge external benefit and leading the cultural resources configuration to be inefficient or invalid.The legal should strengthen the protection of traditional cultural resources,define the traditional cultural property and internalize the externalities.
