| 摘 要： | 物权变动模式关系到物权的设立、变更和终止,是集体林权产权制度的重要组成部分。通过辨析中国现行法律体系物权变动的基本模式、例外模式和专门法律中的林权物权变动模式状况,在综合考虑中国国情、司法实践等情况的基础上,认为在中国集体林权领域应当采取债权形式主义物权变动模式。

| Abstract: | It is a core content of collectively-owned forest rights institution to select change mode of property right of collectively-owned forest,which is closely related to building,changing and ending of collectively-owned forest rights.Based on analysis of circumstance and practice in China,through studying the basic mode,except mode and special mode of property right in law system,the paper suggests that the form mode of debt claim should adopted in the realm of property right of collectively-owned forest. |
