中国动物保护立法问题探析

通过法律手段保护动物资源已成为当代社会的共识。在国外,有关保护动物的立法实践已有近200年的历史,禁止虐杀动物已成为文明社会的共识。而中国动物保护立法起步晚,情况不容乐观,中国应加快步伐,参照国外先进的立法经验,结合中国国情和法律文化、传统,完善动物福利立法。分析中国动物保护现状和立法的必要性,并提出通过立法这种具有威慑力和确定力的手段是促进国民动物福利意识的提高、改善动物的生存现状的现实可行的解决途径。

Study on the Legislation for Animal Protection in China

It is a consensus to protect animal resources by means of laws in contemporary society. In foreign countries, the relevant laws on animal protection have been carried out for nearly 200 years, while the legislation of animal protection started late in China. Moreover, the present situation on it doesn＇t allow optimistic thoughts. We should accelerate the improvement pace of animal welfare legislation referring to the advanced experience on the legislation in other countries, combining with legal culture and legal tradition in China. This paper analyzes the situation of animal protection and the necessity of legislation in China. It is proposed that legislation of animal protection is a powerful means and it is a feasible solution to strengthening the national people＇s awareness about animal welfare and improve survival situation of animals.
