中国环境权社会救济制度的构建

环境侵权的特殊性使得传统救济方式在环境权保护上的局限性日益凸显。面对频发的环境事件,环境权的有效救济问题亟待解决。我国应当建立环境权的社会救济制度,通过修改环境立法,推行环境损害赔偿救助基金制度,建立环境侵权强制责任保险制度、环境侵权行政补偿制度,构建完善的环境权救济机制。

On The Construction of the Environment Right in China Social Relief System

Peculiarity of the environment tort more and more constrains the environment protection right of traditional remedies.Facing to the frequent occurrence of environment affairs,effective remedy of environmental right should be solved.The authors argue that China should establish the social relief system of environmental rights,modify environmental legislation,implement environment damage compensation assistance fund system,establish environment tort compulsory liability insurance system and environment tort of administrative compensation system,and construct a perfect environment right relief mechanism.
