论我国行业协会功能的法律界定

自1997年以来我国行业协会的主要功能被定位为协助政府加强行业管理，许多功能需要政府部门授权或委托；而由于立法上没有规定行业协会的功能，使得行业协会承担社会责任的功能没有突出；因此，今后应在立法上更准确定位行业协会的自有功能及协助管理功能。

On Legal Definition of Function in China's Guild

After summary of the current functions performed by the guild in China,this paper indicates the main functions have been specified to assist the government with management since 1997,which are subject to authorization or consignment from the government. Since the functions are not designated by laws,the guild is not emphasized on undertaking social responsibility,and on which the paper is based,it dwells on how to precisely define the functions of the guild through legislation.
