| 摘 要： | 个人存款的法律性质在法学理论、立法实践以及实际生活中均存在着含混之处。该法律关系既不属于纯粹的债权,也不属于纯粹的物权,而应当将其界定为具有物权性的债权法律关系较为符合中国现有的立法实践,也符合中国的传统金融文化以及客观现实。

| Abstract: | There is ambiguity in the legal nature of personal savings account,in either legal theory,legislative practice or real life.Such legal relations belong to neither purely obligatory right,nor pure property right.Instead,it should be defined as the obligatory right with the character of property right.Such definition conforms to the current legislation practices and tradition finance culture and social realities. |
