中国社会性规制模式探析

社会性规制是以保护国民健康和安全为目的的规制.建立"适度型"社会性规制模式主要有三个方面要求:一是规制者职能必须适度,要完善激励--监督机制,加强对规制者的规制以及审计规制,并积极实行多元共治;二是规制立法程序必须规范,确保利益集团的均衡博弈,逐步完善规制法规;三是必须引入竞争机制,提高规制效率,降低规制成本,实现经济效益与社会效益的统一.

On the Mode of Social Regulation in China

The aim of social regulation is to protect the security and health of national people. The establishment of such regulation mode must conform to the following demands. Firstly, the function of the subjects of the regulation must be appropriate. We must perfect the mechanism of incentive-supervise and strengthen the regulation to the objects of regulation and audit. Secondly, draft procedure of the regulation rules must be standardized to ensure the balance between the interests groups and perfect the rules of the regulation. Thirdly, in the process of social regulation, we should make use of competitive mechanism to reduce regulation cost and raise regulation efficiency, and earnings to get some kind of balance between social benefit and economic benefit.
