论和谐旅游视野下的旅游合同

旅游合同是私法主体之间确定权利义务保障和谐旅游的法律文件。但遗憾的是，直至今日我国还没有一部规制旅游活动的基本法律，学界对于旅游合同的理论研究也很单薄，这与我国旅游业的发展规模极不相称。然而在旅游活动中存在的问题伴随着旅游业的发展也逐渐显现出来，特别是旅游者合法权益被侵害的问题，已成为广大旅游者越来越关注的问题。

On the Touring Contract Under the View of Harmonious Tourism

The touring contract is the law document that the Private Law ascertains that right duty ensures touring harmonious between two parties.But up to now,There are still no a fundamental low for regulating the touring in China,the reasearches on touring contract is also very thin,which is inappropriate to the scale of tourison in China.The problems in the touring activities arouses along with the develpment of tour industry,and the cases that the custamers right's encroached becomes the focus of the public.
