| 摘 要： | 我国已初步形成道路交通事故受害人三元救济制度框架,但是,其具体制度构成和制度体系在保护受害人权益方面还存在诸多漏洞,尤其是道路交通事故社会救助基金制度的设计瑕疵,导致特定情形下的受害人利益仍无法获得保护。

| Abstract: | China has initially formed ternary relief for the victims of institutional framework.However,for a specific system,there are still loopholes in the protection of victims rights and interests,particularly design weakness in road traffic accidents of social relief fund system,resulting that the interests of victims are still unable to protected in specific circumstances. |
