TRIPs体系与我国知识产权保护面临的挑战

知识产权保护是世界贸易组织的三大支柱之一,并起着越来越重要的作用。世界知识产权组织（WIPO）本身的缺陷、GATT/WTO机制的优点和强制力、某些发达国家或地区的极力推动等因素的综合作用是《与贸易有关的知识产权协议》（TRIPs协议）产生的背景原因。发达国家和发展中国家在TRIPs缔结过程中有着不同立场。我国知识产权保护历史短暂,保护意识比较淡薄,保护制度不健全,特别是经济和社会发展相对落后,现代化程度较低,知识产权保护面临着严峻的考验。应该采取辩证地看待知识产权制度、研究国际上发达国家的知识产权立法并提出相关对策、创新企业的知识产权保护、利用国际知识产权保护规则存在的弹性条款与空间维护国家利益等措施来加强我国的知识产权保护工作。

Trips system and the protection of intellectual property rights challenges

The protection of intellectual property right is one of the three pillars of the world trade organization,and plays a more and more important role.The reasons for the emergence of TRIPs agreement are the defects of WIPO,the power of enforcement of GATT/WTO and the promoting of some developed countries and areas.Due to unsound protection system and indifferent awareness,the protection of intellectual property right faces serious challenges.This article points out that the system of intellectual property right should be treated in a dialectic way and the experiences of the developed countries should be drawn on to push the development of Chinese intellectual property right.
