| 摘 要： | 设链者作为网络服务商，没有主动审查侵权的义务，但在知悉侵权行为之后，必须承担及时制止侵权的义务，这其中侵权通知是制止侵权继续较为一致的规定，而美国的“红旗标准”则对链接提供者提出了更高的要求。
