论采矿权的性质及其权利行使

<物权法>第123条规定,依法取得的采矿权受法律保护.该条被视为对采矿权定性的条文,极具标示意义.但采矿权从其产生、行使到灭失无不因权利客体的自然特性以及公权力的参与渗透而与其他权利有所区别,而且与其他权利发生冲突的可能性高,因此,探索采矿权的特征的多层面性,并且研究其与矿产资源所有权、探矿权、建设用地使用权、土地承包经营权、地役权等权利的协调至关重要.
