摘    要:研究目的:提出征地范围改革方案,进行实地调查与测算,为征地制度改革进行试点,为《土地管理法》修改、编制土地征收目录提供依据。研究方法:资料综合分析法、案例比较分析法、调查研究法。研究结果:土地征收范围过宽,超出“公共利益”的范畴。将土地征收权扩展到了整个经济建设用地,没有区分公益性和经营性建设用地,将本应以市场行为获得的商业性开发用地也纳入国家土地征收权的客体范围,导致民事主体的私权被国家公权力不正当地剥夺。数据统计分析,在各类建设项目用地中,属于营利性质的工商业、房地产等城市经营性用地征收集体土地占总征地面积的21.9%。在划分征地范围时,建议根据基本国情分步骤、循序渐进地缩小征地范围。

Abstract:The purpose of the study is to put forward plans for the reform of land requisition system in China through investigation and to provide theory underpinning for the determ ination of pilot cities of reform,the re-vision to Land Administration Law and the form ation of land requisition directory.Method of docum entation and case study wereem ployed.The results show the land requisition right has covered the entire land for cons-truction,which is beyond the scope of public interest.Projects for public interests have not been distinguished from nonp-ublic interest projects.Land for com m ercial use is acquired by requisition rather than through the market.The requisition of collective-owned land for commercial,industrial and residential use accounted for 21.9% of the total.Actual conditions of China have to be taken into full consideration in dividing land requ-isition scope,which has to be narrowed step by step.
