农村集体土地征收补偿问题、原因及对策

农村集体土地征收补偿中存在征收补偿标准偏低;农民对补偿金数额不满意;公正、合理是制定补偿标准最需要考虑的因素;补偿的补偿方式单一;补偿金归属问题令人担忧;补偿中的法规、政策等信息不透明等问题.其主要原因有三个方面,一是城市化发展不可避免地损害了农民的利益;二是公共利益名誉掩盖下的政府利益本位损害了农民的利益;三是农村集体土地征收补偿标准计算方法背离市场基本价值规律.因此,要从五个方面来完善农村集体土地征收补偿,一是建立城乡统一的土地流转市场;二是科学制定农村集体土地征地补偿标准;三是增设集体土地产权出让制度;四是公开农村集体土地征收补偿程序信息;五是转变政府职能,依靠政策法规和市场机制行事.

The Existing Problems in Compensation for the Expropriation of Rural Collective Land and Its Reasons and Countermeasures

This paper firstly introduces the existing problems in compensation for the expropriation of rural collective land through visits, questionnaires and interviews, such as low compensation standard, unsatisfactory amount of compensation and single way of compensation. It then analyzes the main reasons. Finally, it puts forward the perfection of compensation for the expropriation of rural collective land as follows： establishing a unified urban and rural land circulation market; formulating the scientific compensation standard; creating transfer system of collective land ownership; public information in compensation for the expropriation of rural collective land; relying on policies, regu- lations and market mechanisms to act by transformation of the government functions.
