杭州市城市房屋拆迁补偿政策变迁

研究目的:通过对杭州市城市房屋拆迁补偿政策变迁的研究,总结拆迁补偿政策的演进规律和机制。研究方法:历史研究法,个案研究法和文献研究法。研究结果:城市房屋拆迁补偿模式经历了从货币补偿转向产权调换,再回归货币补偿的发展过程,补偿程度从不公平向公平逐渐演进。这些变化主要受土地制度和经济体制演变的影响。研究结论:由于政府没有从根本上改变漠视私有财产权的错误观念,加之其强烈的经济人意识,在今后较长一段时期内,拆迁补偿矛盾还将存在,公平补偿仍是城市房屋拆迁补偿的努力目标。

Policy Change of Compensation for Demolition and Relocation of Civic Buildings in Hangzhou City

The purpose of this paper is to summarize the evolution and mechanism of compensation for demolition and relocation of civic building through the analysis on the policy change in Hangzhou City. Methods of historical research, case study and documentation were employed. The results indicate that the mode of compensation for demolition and relocation of civic buildings has experienced from monetary-oriented to property right exchange oriented and again returned to monetary-oriented, during which the compensation was gradually to be fairer. These changes are mainly influenced by the evolutions of land system and economic system. It is concluded that because government does not change its mental model that discriminates the private property rights and follows the so-called“economic man” strategy, the contradictions within the compensation for demolition and relocation will continuously exists for a long term in future. Fair compensation will be a continuous goal of the policy reform.
