探讨土地征收中公共利益的界定

何为“公共利益”？如何界定“公共利益”？这是近年来农村土地征收中的焦点问题。随着中国城市化、工业化进程的加快，大量的农村土地转化为非农业用地，失地农民数量急剧增加，引发了大量的冲突和社会矛盾，而导致各种冲突和矛盾的深层原因在于公共利益被泛化，使政府在征地过程中经常出现滥用征收权、征地范围扩大化以及侵害农民权益的现象。要保障农民的权益，必须明确地界定公共利益的范围。通过探讨公共利益的内涵、界定方式及界定主体，最后对公共利益界定的立法程序提出建议。

What is the ＂public interest＂？ How to define the ＂public interest＂？ This is a main issue in the process of rural land acquisition in recent years.As China＇s urbanization and industrialization speed up the process, a large number of rural land change into non-agricultural land, the number of landless peasants sharply increase, giving rise to a large number of conflicts and social contradictions.The reason leading to various conflicts and contradictions lies in the fact that the public interest be generalized and land acquisition compensation mechanism is extremely unreasonable.To protect the rights of landless peasants, we must clearly define the scope of public interest and improve China＇s land requisition compensation mechanism.In this paper,through explore the meaning of pubhc interest,the methods of defined and the main body of defined, at last, put forward the recommendations for the public interest as defined in the legislative process.
