浅议我国信托公示制度

信托制度是一种基于信任而委托他人管理财产的法律制度,作为英美法系的一种特殊的财产制度安排,信托财产的独立性是确保信托发挥其作用的关键所在,其也决定了信托公示制度设立的必要性。然而,我国信托立法中对信托公示制度的规定相当粗糙模糊。本文通过对信托制度基本制度的剖析,立足于我国现行立法,提出了构建我国信托公示制度的现实方案。

Brief Discussion on the Trust Publication System in China

Trust system is a law system that someone entrusts other people to manage his/her property based on trust,and it is a special property management in British and American laws. The independence of trust property is the key to develop the role of trust,and it decides the necessity of trust publication system. In China,the regulations of trust publication system in the trust legislation is not so clear and specific. Based on China’s current legislation,this article analyzes the basic trust system and presents the practical project to construct China’s trust publication system.
