浅谈我国自然资源法律保护机制

我国自然资源保护机制中存在如下问题:一些地方重GDP增长,轻自然资源保护;自然资源保护法制不够健全,自然资源保护立法未能完全适应形势需要,有法不依、执法不严现象较为突出;自然资源保护机制不完善,投入不足,历史欠账多,污染治理进程缓慢,市场化程度偏低;自然资源管理体制未完全理顺,管理效率有待提高;部分领导干部自然资源保护意识和公众参与水平有待增强。应通过建立自然资源生态补偿法律制度、确立自然资源保护司法审查制度、建立完善自然资源公益诉讼制度、加强刑事制裁等来健全我国自然资源的法律保护机制。
