论人权法治全球化的动因与演变

在人权发展全球化的趋势下，各国必须对国际强权与不法权力进行法律控制，协调各主权国家内部的人权与主权关系，将人权问题纳入全球法治的法律体系中，实现人权全球保护的法治目标与状态。人权法治全球化的深刻动因在于经济全球化的推动、二战的历史教训以及现实的国际强权政治与不法权力的存在。人权在趋向全球化的演变过程中，存在一个由国内走向国际、由狭隘走向全面、由区域走向全球、又由全球影响区域的过程。在这一过程中，全球人权法律制度也由零散走向系统、片面走向全面。

On the Motive and Evolvement of Globalization of Human Rights Law

In nowadays,human rights have a tendency of globalization.The whole world society must control the power and illegal authority by the international law and make human rights and sovereignty under the coordination,so the whole world society could make the protecting of human rights of globalization be true under the system of international law.There are three reasons which promote globalization of rule of law in human rights: economic globalization,the lessons of the Second World War and the power and illegal authority.During the process of globalization,it would have to experience the procedure from domestic to abroad,from sided to all-round and from regional to global.Thus,the whole law system of human rights would develop from scattered and single-faceted to all-round and systematic.
