| 摘 要： | 司法适用中，将作为小前提的案件事实涵慑于作为大前提的一般法律规范的过程中，其关键环节在于司法人员对法律的解释。由于法律语言的“空缺结构”和法律解释的主体性等原因，一个法律规范存在一组法律解释结论，但是，针对一个具体的案件，只有一个结论是最佳的，即具有合法性又是最合理的，这个最佳的结论就是正当的法律解释。获得正当性法律解释需要实体和程序两方面的保障。
