| 摘 要： | 从我国的立法现状看,有关环境纠纷的处理和环境损害赔偿的规定散见于<民法通则>、<环境保护法>、<水污染防治法>、 <大气污染防治法>等法律之中.鉴于全球化的环境问题日趋严重,环境污染事故不断发生,有必要加强环境保护立法,借鉴国外的先进经验,立足我国的实际,确立相应的"环境民事公益诉讼制度、环境损害赔偿范围、环境损害赔偿责任社会化机制",制定统一的<环境损害赔偿法>.
