《劳动合同法》对商业秘密的民法保护——从企业社会责任的角度

摘    要:新颁布的《劳动合同法》规定了竞业限制条款,使企业商业秘密民法保护法律化,强化了企业知识产权保护,有助于提高企业竞争力;同时对雇员择业权、生存权、求偿权的保障存在缺失,影响了劳动法的价值实现。本文认为,劳动合同的法律价值在于实现雇主和雇员利益的平衡:雇主对雇员权益的保障是企业应承担的社会责任之一,是企业可持续发展的根本。

About Law of Employment Contract Protects on the Trade Secret in Civil Law——on the Enterprises' Social Responsibility

Abstract:Law of employment contract issued latterly prescribes the terms on the competition restriction,which practises protection of trade secrets in civillaw.It has advantage for improving competition and the protection of intellectual property.Meanwhile,it is short of protection in right of choice job,right of subsist and compensation.The article suggests that the point of employment contract is to keep profit balance between the employer and the employee.It is one of enterprises'social duty that employer protect the employees'profit,which is the base for developing enterprises.
