| 摘 要： | 目前 ,停车收费的行为究竟属于保管还是租赁在立法中没有明文规定 ,在实践中对此问题存在较大争议 ,又因为对这种行为的定性与当事人的权利密切相关 ,为此 ,本文对停车收费行为性质进行评析 ,并在此基础上提出立法建议

| Abstract: | Up to now,there is no express provision in the law as to whether the act of charging for parking belongs to storage contract or leasing contract,which causes biggish disputes in practice.Also,the nature determination for this act is closely related to the right of the party concerned.For these reasons,the article analyzes the nature of the act charging for parking,and on its basis,makes some legislative suggestions. |
