论城乡一体化视域下集体土地所有权的走向

研究目的:在对城乡一体化实现之后的社会图景进行基本把握的前提下,确认集体土地所有权存续的可能性和必要性以及演进的应然形式。研究方法:演绎法,归谬法。研究结果:在城乡一体化目标视域下,集体土地所有权得以存在的身份基础将丧失,其制度功能亦将失效,故集体土地所有权必将消亡。另一方面,以私人所有权替代集体所有权亦不可取。研究结论:在构建完备的农村土地用益物权体系基础上,以国家所有权概括承继集体所有权方是正途。既与中国基本经济制度相符,同时亦保持了城乡法制统一,并真正能够实现土地资源的市场配置。

Trend of the Rural Collective Land Ownership Reform from the Perspective of Urban and Rural Integrated Development

The purpose of this paper is to clarify the possibility and necessity of the existence and the evolution of the collective land ownership regarding the national strategy of urban and rural integrated development. Methods used include deductive method and reduction to absurdity. The results indicate that the basis of the rural collective land ownership will be lost in the future and also the function of the rural collective land ownership will be lost according to the goal of the integrated development. Eventually, the rural collective land ownership will disappear. Additionally, it is not a solution to use the private ownership to substitute rural collective land ownership. The paper concludes that on the basis of constructing the rural usufructuary right system, using the state ownership to replace the rural collective land ownership will be the positive solution. It will be in accordance with the basic economy system, keeping the uniformity of land law and really achieving the market-oriented reform of land resources allocation.
