摘    要:优先购买权作为承租人的一项法定权利,对其全方位的法律保护有利于提高房屋的利用率,维护和稳定既有物的使用关系。我国现行合同法明确规定了房屋承租人的优先购买权,但优先购买权行使主体的规定不明确,提前通知期限条款与其他法律规定存在不一致,且承租人请求撤销出租人与第三人之间的房屋买卖合同的权利保障不统一,需要完善相关法律规定以明确优先购买权的行使主体,出卖人的提前通知期限以及承租人可向出租人主张违约责任。

Abstract:Preemptive right is the lessee's legal right,and it is helpful for improving the utilization ratio of the houses,as it could maintain and stable the relationship between the existing contents.The current contract law clearly specified the tenant's preemptive right.But the provisions of the preemptive right subjects is not clear.Advanced notice period terms are not consistent with other laws.Besides,the law does not give the lesser and lessee the rights for canceling a third of building business contract,it needs to perfect the related legal provisions in order to make clear the pre-emptive right exercising main body,The seller advance notice period and the lessee may claim to the lesser for the breach responsibility.
