国际金融监管模式有以美国、德国为代表的多元化金融监管模式和以英国、日本及韩国为代表的一元化金融监管模式两种法律定位。借鉴主要金融市场国家金融监管模式的法律定位的发展过程,我国金融业混业经营趋势下的金融监管模式法律定位,应当顺应一元化金融监管模式潮流、构建监管者之间有效的协调机制、充分发挥社会监管的作用、健全对监管者的外部监督机制和学习他国金融监管模式法律定位的成功转型经验。

Development of Law Orientation with International Financial Regulatory Pattern and Revelation for China

International financial regulatory pattern has two types,one is the multiplex financial regulatory pattern（America,Germany are examples）,the other is unified financial regulatory pattern（UK,Japan,South Korea are examples）.After itstudies the development of law orientation with main financial market countries＇ regulatory pattern,the law orientation of Chinese financial regulatory pattern under trend of model of mixed financial operation needs to follow the tide of unified regulatory pattern,create effective harmonizing system between supervisors,fully exert functions of social supervision,improve outside supervision system to supervisors,learn successful experience for transformation to law orientation with financial regulatory pattern.
