公民立法提案制度的必要性探析

立法提案是立法程序的入口，也是体现立法民主化的重要环节。本应体现广泛民意的立法提案，实践中受到体制内外的严重纷扰，于是有学者主张赋予公民立法提案主体地位。显然，在人民代表大会政体之下，这种主张并不可行。但不可否认，立法民主化是大势所趋，应切合实际地设计相关制度，保障立法提案的顺畅，使民意之所需成为立法之所急。

Exploration on the Necessity of the Citizen Legislative Proposal System

Legislative proposal is the first step of legislative procedure as well as a key link to reflect the democracy in legislation. Though it is supposed to represent public opinion, it receives severe interference both inside and outside the system in the practice. In light of this, some scholars have suggested that citizen should be the legislative proposal subject. Obviously, it is not feasible under the the People＇s Congress System. But at the same time we cannot deny that democratization of legislation is an unavoidable tendency, thus we should design relevant systems according to the real situation to guarantee smooth legislative proposal procedure and make law according to the public opinion.
