| 摘 要： | 专利权质押制度是当今社会经济生活中以专利技术融资的重要的渠道。我国现行《担保法》首次明确规定了专利权质押,但总体来说内容比较愿则,操作性不强。本文结合专利权质押的实践对专利权质押的标的、设定和效力等理论问题进行了探讨,力求为专利权质押的发展提供理论支持。

| Abstract: | The patent mortgage system, as an important financing channel for the enterprise with its patent, is embodied in the Guarantee Law. However, the regulations concerning the patent mortgage in the Guarantee Law is rather principled and weak in practice. For the purpose of smoother development of the patent mortgage, based on the characteristics of the patent right, this article carries on a theoretical discussion and analysis on the sign of patent mortgage, the establishment of the patent mortgage and the validity of the patent mortgage. |
