| 摘 要： | 科学设置矿业权制度、合理界定矿业权法律关系，对于我国物权法的制定有着深远的意义。本文从矿业权法律关系的构成要素入手，对矿业权主体、客体以及权利义务三个方面的问题进行了较深入地分析，以期有助于完善我国的矿业权理论。
