保险诈骗罪共犯问题新探

在内外相互勾结骗取保险金的情况下,只能成立贪污罪或保险诈骗罪的共犯,而不能成立职务侵占罪的共犯。在内部相互勾结骗取保险金的情况下,非国家工作人员与国家工作人员相互勾结,分别利用各自的职务便利,共同骗取保险金时,应以贪污罪确定共同犯罪的性质;非国家工作人员与国家工作人员只是利用一方的职务便利,共同骗取保险金时,应根据该方的身份确定共同犯罪的性质。
