| 摘 要： | 无限防卫权产生在正当防卫制度的基础上。新刑法中的“行凶”涵盖多种暴力犯罪手段不尽科学,杀人 等四种犯罪的界定不尽明确,需要在司法实践和司法理论上进一步规范。

Probe into the Application of Limitless Defence Right |

| Abstract: | Limitless defence right comes on the basis of legitimate defence system. In the new Criminal Law, the definition of "murder" which relates to many violent criminal means is not very scientific,and the bounds of the four crimes relating to killing a person is not very explicit,so they need to be further regulated in judicial practice and theory. |
