中国新型城镇化过程中失地农民权益保障问题研究

土地是人类赖以生存和发展的最基本的物质基础,也是农民的生产资料和生计源泉。在城镇化建设和发展的过程中,失地农民是由中国城乡二元体制的客观因素造成的。征地制度、户籍制度的缺陷和农村社会保障率低下等因素使失地农民的生存权和发展权受到极大的挑战。文章认为,增强失地农民权益保障重点是要把握好"公共利益"的维度,完善征地补偿机制;建立城乡一体化社会保障体系,实现城乡统一发展;完善农村土地"双置换"。

The Protection of the Rights of Land Expropriated Peasants in the Process of Urbanization in China

Land is not only a basic material of human survival and development, but also a source of production and livelihood of farmers. In the process of urbanization and development, the dual system of urban and rural caused the land expropriated peasants. The imperfect of land requisition system, household registration system and social security in rural areas caused a great of challenge for the survival and development of land expropriated peasants. This paper considers that we have to protect the interests of land expropriated peasants, improve land compensation mechanism; establish an integrated urban and rural social security system; achieve a unified urban and rural development and improve rural land ＂double substitution＂.
