论经济法的社会本位思想

经济法是社会本位法,在对经济关系的调整中立足于社会整体,在任何情况下都以大多数人的意志和利益为重,社会公共利益至上。社会本位思想是经济法产生的基础,体现于经济法的本质性原则,决定了公平、正义的价值取向以及可持续发展的最终目的。经济法从始至终体现着社会本位思想,并且对我国经济公益诉讼制度的构建与完善,也有重要的启示作用。

Thoughts of the Social Standard of Economic Law

The economic rules and regulations are law of the social standard, in the adjustment of the economic relationship based on the community as a whole. Under any circumstances, value the interests of the people above everything else, take the social and public interests first. Social standards is the birth bases of the Economic Law, to embody the principles of Economic Constitution, to decide the orientation of value in the Economic Law is equity and justice, to resolve the final realization of sustainable development. The social standards recur throughout the Economic Law, and still play an important role in setting up the system of economic public good proceedings in our country.
