| 摘 要： | 近年来,由于反托拉斯经济理论和美国经济的发展,美国反托拉斯司法实践出现一些新的变化。本文在介绍和评价这些新变化的基础上指出重视一贯的效率原则指向是美国反托拉斯法的重要特征,并且体现出由过去侧重静态效率向侧重制度效率和动态效率转变的特点。据此,作者提出我国反垄断立法的原则指向应是效率原则指向,并指出目前应重点突出动态效率原则指向。以此为基础,探讨了我国反垄断立法中的一些主要问题。

| Abstract: | With the development of antitrust economics and US economy, US antitrust law has been changing greatly. Based on the analysis of those change, we consider it is a very important character to pay much attention on efficiency, and it is not only static efficiency but also dynamic efficiency. So, we point out that the objective and rule of Chinese antitrust law is also dynamic efficiency. At last, we analysis some important issue about Chinese antitrust law. |
