维权与维稳的冲突与化解——基于法治思维与法治方式的考察

如何合法、正确、有效处理维权与维稳这一矛盾是行政法和行政法治面对的一个重大理论和社会实践问题。在一个法治环境日渐优化,通过对维权与维稳的性质、特点、种类和冲突的行政法分析,提出摒弃以政治思维、权力思维的方式解决和处理维权与维稳的冲突的习惯,以法治思维方式重新认识维权与维稳及相互关系,以合法与否为价值判断标准,并在此价值标准判断下,选择相应的法治方式化解维权与维稳的矛盾冲突,是化解维权与维稳的根本之策。

Conflicts and Resolution between Power Control and Stability Maintenance

It is of great theoretical and practical significance to administrative law and its rule how to legally,correctly and effectively deal with the contradiction of power control and stability maintenance.This paper analyzes the qualities,characteristics,types,as well as conflicts of power control and stability maintenance and proposes to reject the habit of handling conflicts of power control and stability maintenance through political and power thinking and reconsider the relation between them by legal thinking with the value criteria of being legal or not.Choosing the corresponding legal solution on this standard of value judgment is an essential way to resolve the conflicts between power control and stability maintenance.
