| 摘 要： | 从利益返还请求权的基础理论和各国立法入手,分析利益返还请求权产生的原因,并在对各种利益返还请求权性质学说评价的基础上提出自己的认识。采用比较研究的方法,对我国《票据法》第18条和日本、我国台湾地区票据法的相关规定作一分析对比,并通过对利益返还请求权成立要件的讨论,尝试找出完善我国《票据法》第18条内容的途径。
