| 摘 要： | 专利权本身并不包括专利权人实施专利技术的权利。专利权人实施专利技术的权利从开始到终止和专利权的取得到终止没有必然联系,受除专利法外的其他行政法律关系和其他专利权的限制。专利权的这一性质对于涉及专利权的技术交易有着重要影响。正确认识这种性质,是充分利用TRIPS协议,保护市场竞争有序进行和经济水平稳步发展的重要方面。

| Abstract: | Patent right itself does not contain patentee's rights of carrying out patent technology.Patentee's right of carrying out patent technology from beginning to end does not have necessary relationship with the obtainment of patent right,which is restricted by other administrative legal relationship and other patent right.The feature of this in patent exerts important influence on the dealing of patent technology.To know this correctly is important to guarantee the orderly market competition and stable economic development. |
