“丝绸之路经济带”次区域经济合作法律保障探析

“丝绸之路经济带”是我国近来提出的一项重要战略构想，其目的就在于试图沿着古丝绸之路大力打造中国连接欧亚的次区域经济合作区。作为一种较低层次的经济整合模式，“丝绸之路经济带”将对全球和区域经济一体化发展起到有益补充和积淀作用。针对“丝绸之路经济带”次区域合作存在的主要法律问题，应构建正式的多层级合作机制、完善跨界运输法律机制、促进域内经贸立法及法律实施、设置次区域框架下的争端解决机制、构建次区域预警机制和广泛开展比较法学研究以及大力培养次区域有关法律人才。

Exploration on the Legal Protection of the Sub-regional Cooperation of the Silk Road Economic Belt

The Silk Road economic belt is an important strategic concept proposed by China recently , at-tempting to build Chinese -Eurasian sub -regional economic cooperation zone along the ancient Silk Road.As a lower-level economic cooperation model , the Silk Road economic belt has a positive effect on the development of global and regional economic integration .To solve the main problems during the sub-regional cooperation of the Silk Road economic belt , a formal multilateral cooperation mechanism should be established , a multilateral cross-border transportation legal mechanism be formed , the invest-ment and trade legislation and enforcement of the law be improved , the dispute settlement mechanism un-der the framework of the sub -regional zone be set up , a sub-regional early warning mechanism be con-structed , an extensive comparative legal research be developed and a large number of sub -regional legal talents be trained .
