| 摘 要： | 目前,无效合同所涉请求权是否适用诉讼时效在我国法律中没有相关规定,也是司法实践中的难点。无效合同的确认不应受诉讼时效限制,由无效合同产生的返还财产请求权和损害赔偿请求权应受诉讼时效限制,并且该诉讼时效期间应从确认无效合同裁判生效之日起计算。

| Abstract: | Currently there are no relevant provisions in laws in China about illegal contract involved in the claim whether is applicable to limitation of action,and it is also a difficulty in judicial practice.The return property produced by invalid contract and the claim for damages shall be subject to the limitation of action.And the limitation of action should be confirmed as invalid contract effective date of the referee. |
