| 摘 要： | 随着市场经济体系的逐步健全,市场交易的范围不断扩大,市场主体多样化、法律关系复杂化、利益追求激烈化、矛盾纠纷尖锐化的态势日益凸显。在构建社会主义和谐社会的进程中,审判人员应坚持以科学发展观为统领,着力更新理念、创新机制、讲究方法、拓展效果,探索建立科学、高效的商事调解机制,力争调出和谐,解去纷争,以最小的司法成本实现最大化的社会效果。
