论政府对公共利益的追求及其滥用

消解不同利益集团的冲突以维护公共利益是政府的重要责任,然而,因公共利益内容和对象的不确定性而常常为政府所滥用。其实,公共利益与个人利益是相互依赖和制约的关系,政府利益并不等同公共利益。为防止因政府滥用公共利益而引发与公众之间的冲突和造成对政府公信力的伤害,应通过立法机关依法界定公共利益,公众在公共利益上应当具有监督、参与、要求补偿和救助等权利。

On Government's Pursuit for the Public Interest and the Abuse of Power

It is government＇s important responsibility to defend the public interest through dispelling the conflicts among the different interest group.However,government often abuses its power because of the uncertainty of the object and the content of the public interest.In fact,the public interest and the personal one restrict and lean each other and the government interest is not same as the public interest.In order to avoid the conflicts between governments and the public and prevent from hurting the credibility caused by government abusing its power for the public interest,we should make a doubtless definition of the public interest through the legislature.The public should have the right to supervise,participate,be compensated and rescued on the public interest.
