关于高校不和谐问题的法律思考

构建和谐社会是我国在新的历史形势下制定的一项全方位治国方略,构建和谐高校也是其中的重要内容。但是,现阶段我国高校甚至高等教育领域中却存在着大量涉讼案件。由于对纠纷性质认识的不同,人民法院未将所有纠纷纳入司法审查范围,从而加剧了高等教育领域的不和谐。要构建和谐高校,应该建立高校与学生特别权力关系理论,建立对高校自主管理权的有限司法监督原则,完善教育立法,构建和谐高校。

Building the harmonious society is a strategy of ruling socialism country,and the socialist rule of law is the most important tasks and strongest guarantees.Building the harmonious society is a "all-round" strategy of ruling socialism country,including the area of higher education.Because the cognition of "entity body" which was founded in the traditional economic system doesn't confirm the administrative subject of university,at the same time,the law doesn't make clear the content of exclusive right,it brings about series of litigations.Ruling the university according to law and building the harmonious university,firstly,we must establish the correct theory of relation between university and students;secondly,we must set up the regulation of justice supervision;lastly,we must establish the judicial appeal system and perfect the law.
