数字产品创新激励机制:知识产权保护维度研究

摘    要:数字产品是数字与网络技术发展产生的新产品,其创新保护关系到数字产品的健康发展,数字产品的创新保护成为新经济形态下,经济学研究者面临的现实问题。由于传统知识产权注重知识产品的排他性所有权,因此,传统的知识产权对于数字产品创新保护虽有可借鉴之处但并不完全适用,设置数字产品的知识产权,并制定相应的保护维度是确立数字产品创新机制的重要途径。由于数字产品的特性,数字产品创新保护维度也存在明显的不同,数字产品的知识产权设计必须在保护期和权利设置的二维选择模式下进行权衡。

Abstract:Digital product is new things produced by digital and network technology development, its innova- tion protection is related to the healthy development of digital products. Digital - product - innovation protection be- comes a real problem faced by economics researchers under the condition of the new economic form. Because the tradition intellectual property pays attention to the exclusive ownership of knowledge products, therefore, the tradi- tion intellectual property can be used for reference but not completely applicable for digital -product -innovation protection, setting the intellectual property of digital products , and formulate the corresponding protection dimen- sion is the important way to establish the digital product innovation mechanism. Because of the characteristics of digital products, the intellectual property rights designing of digital products must be weighed in the mode of 2D pattern choice between protection and rights setting.
