摘    要:业主专有权是业主权体系中的核心权利,是传统物权法中建筑物区分所有之专有权的上位概念。只有将业主专有权定性为占有方能完成其与一物一权原则的完美对接。业主须在专有部分的空间范围内有限地行使专有权,当业主专有权受到侵害或无法实现时,业主可以采取公力或私力的方式进行救济。

Abstract:The owner' s exclusive fight is the core right in the system of property owner' s rights, which is the upper concept of the building separating ownership in the traditional property law. Exclusive right should be defined as possession ; only in this way can it be in line with the doctrine of one thing, one fight. The owner must exercise the exclusive fight within the scope of exclusive part limitedly. When the exclusive right is violated or can not be realized, the owner can relieve the right by way of public or private force.
