商业方法专利保护及其对中资银行的影响

商业方法专利是国家赋予权利主体对某种商业运作方式或模式的独占权。商业方法专利是服务经济的产物。率先向服务经济转型的西方发达国家已经打开了商业方法专利保护的大门。我国还处在工业化发展阶段,实行商业方法专利保护不利于我国服务经济的发展。但是发达国家商业方法专利保护的立法趋势对中资银行造成了一定的冲击。中国政府和中资银行应采取有效措施来应对这一挑战。

Business method patent is an exclusive right to a specific mode or method of doing business conferred by a country.The business method patent was born in the service economy.The western developed countries which have entered to the service economy have begun to protect business method by patent law.China is still in the period of industrialization development.The protection for business method by patent law is unbeneficial to the development of Chinese service economy.However, the trend of legislation that the western developed countries protect business method by patent law has been striking Chinese capital banks.Therefore, Chinese government and Chinese capital banks should take countermeasures to accept this Challenge.
