| 摘 要： | 格式条款减化了交易过程,降低了交易成本,同时也剥夺了相对人主要是广大消费者平等协商的权利,使合同公平原则受到极大挑战。对格式条款解释的性质探讨、主体的界定、对象的明确以及具体规则的阐述,有助于使交易天平重新平衡。对格式合同的解释应坚持客观、公平、诚实信用总的指导思想,尽可能地保护相对人主要是广大消费者的合法权益,实现社会主义。

| Abstract: | Format clauses simplify the process of transaction,decrease the cost of transaction and at the same time also deprive the right of equal consultation of the other party,especially a wide range of consumers.As a result,they are a great challenge to the equity principle of contract.Discussing the explanation property of format clauses,defining their main parts,specifying the objects and elaborating concrete rules help to resume the balance of the transaction scale.The interpretation of format clauses should stick to the guideline of objectivity, equity,honesty and credit,try to protect the legal rights of the other party,especially the consumers,to realize social democracy. |
