| 摘 要： | 从我国现有法律考量,正午退房制并不违反有关的时间计算规则,符合格式条款的有效要件,亦没有足够的法律根据表明其侵犯了消费者的公平交易权;但正午退房制与人们的生活习惯不完全吻合,确实给旅客带来诸多不便,属于并不违法,但未尽合理的行规。彻底废除这一既有行规的意见未必可行,对这一行规进行改进的方向应当是:在保留现行旅馆业惯例中对旅客有利的规则的同时,将正午退房的时间延至14时,而18时后退房加收一日房费的做法则可以维持;同时,对12时之前入住的旅客在房费计算上应当另立特殊规则。

| Abstract: | Considering from our available law,we think noon check-out system does not violate relevant time calculation rule,which conforms to the effective elements of format clauses.Not enough law can indicate that it encroaches upon the fair dealing right of the consumers.However,this system does not accord with our living habit and brings lots of inconvenience to travelers.It is neither illegal nor reasonable.It might not be feasible to completely abolish this regular practice.The improvement methods should be:ext... |
