| 摘 要： | CEPA是WTO规则约束下的内地与香港(澳门)两个单独关税区之间签署的协议,是有着强制法律约束力的自由贸易区规则。在CEPA如火如荼推展之时,如何有效设计争端解决机制是一个值得关注的问题。本文主要针对现行CEPA争端解决机制的规定过于原则,有关争端解决模式、管辖范围、程序规则等问题规定不明确的现实情况,通过分析世界贸易组织与其他区域经济组织争端解决机制的法律规定,提出进一步完善CEPA争端解决机制的建议。
